  1. Deferred Disposition Application
    Instructions: You have to complete this form and submit it to the clerk's office. It is your responsibility to follow up with the court at 361-485-3050 or courtclerk@victoriatx.gov to verify receipt of your request. After your request is reviewed, the court will mail or e-mail you a notice of your agreements if you meet the eligibility terms. If you do not meet the eligibility terms, court staff will contact you. You may want to call prior to submitting your request to verify if you’re eligible.
  2. Information regarding Deferred Disposition
    Deferred Disposition is an option that will keep your citation from being reported as a conviction on your driving record and will be dismissed if all terms required are successfully met. If any requirements are not met and you cannot provide a satisfactory reason why at a hearing before a judge, you will be found guilty and a conviction will be reported to the Texas Department of Public Safety. Please note: not all violations are approved for Deferred Disposition.
  3. Terms and Procedures:

    1. Final disposition shall be deferred for 90 days;
    2. The Defendant shows proof of valid Driver’s License or state-issued ID card;
    3. The Court shall impose a Special Expense Fee and court costs of the violation as determined by the Court's fee schedule
    4. Payment options:
    OPTION 1 The Defendant pays total amount of citation as determined by the Court’s fee schedule a at the time the deferred disposition is requested;
    OR
    OPTION 2 The Defendant pays total amount of citation as determined by the Court's schedule in full by the end of the 90 day deferral period
    5. The Defendant is at least 25 years of age, or if less than 25 years of age agrees to complete a driving safety course* approved under Chapter 1001, Texas Education Code; *for moving violations only
    6. The Defendant has not been granted Deferred in the City of Victoria within twelve (12) months of the date of the request;
    7. The Defendant is not currently on Deferred in the City of Victoria; and
    8. During the 90 day deferral period, the Defendant shall keep the court updated of current address, obey all the laws of the State of Texas and the Ordinances of the City of Victoria, and comply with all other deferral requirements imposed by the Judge.

  4. Requests for Deferred Disposition will not be accepted for the below listed offenses:

    1. Any offenses by a holder of a Commercial Driver’s License (CDL);
    2. Any traffic offense that occurred in a construction zone with workers present
    3. The offense is a status offense involving a violation of the Alcohol Beverage Code;
    4. The offense is for Driving Under the Influence pursuant to 106.041 of the Alcohol Beverage Code;
    5. The offense is a status offense involving a violation of Chapter 161 of the Health and Safety Code (Tobacco);
    6. Juvenile cases (must appear in person with a parent or guardian)
    7. There may be other offenses excluded. Please contact the court prior to submitting your request.

    PLEA OF NOLO CONTENDERE I, the undersigned, do hereby enter my appearance on the complaint for the charge in the above-referenced Municipal Court citation number . I have been informed of my right to a jury trial and that my signature on this plea of nolo contendere (no contest) to said offense as charged, will have the same force and effect as a plea of guilty on the judgment of the court. I do hereby plead nolo contendere to said offense as charged, waive my right to a jury trial or hearing by the court and agree to pay the fine and costs the judge assesses. I understand that my plea may result in a conviction appearing on either a criminal record or a driver’s license record.

    PLEA OF GUILTY I, the undersigned, do hereby enter my appearance on the complaint for the charge in the above-referenced Municipal Court citation number. I have been informed of my right to a jury trial and that my signature on this plea of guilty to said offense as charged, will have the same force and effect as a judgment of the Court. I do hereby plead guilty to the offense as charged, waive my right to a jury trial or hearing by the Court, and agree to pay the penalty the judge assesses. I understand that my plea may result in a conviction appearing on either a criminal or driver’s license record.
